Dog death conviction quashed
Posted Tue May 27, 2008 12:20pm AEST

Sydney's District Court has set aside a $10,000 fine imposed on a former prison officer who was found guilty of aggravated animal cruelty.

The court also quashed the conviction of 32-year-old Joshua Peterson, who left a border collie locked in a car for five days.

The sniffer dog died of heatstroke within two years as temperatures rose to 50 degrees Celsius in the car.

The court accepted that Mr Peterson had no intention of harming the dog and forgot about it while he was dealing with a heavy workload.

He has already paid $12,000 in legal costs to the RSPCA.
